O Colegiado negou provimento \u00e0 apela\u00e7\u00e3o do INSS para suspender o pagamento.<\/p>\n<p>No recurso, alegou que a trabalhadora n\u00e3o comprovou o exerc\u00edcio de labor rural pelo prazo de car\u00eancia legalmente exigido, nem sua qualidade de segurada especial, com o prova material corroborada por prova testemunhal.<\/p>\n<p>O relator, desembargador federal Jo\u00e3o Luiz de Sousa, informou que as regras para a concess\u00e3o de aposentadoria por idade de trabalhador rural est\u00e3o dispostas na Lei de 8.213\/1991.<\/p>\n<p>No caso em quest\u00e3o, a lei diz que a aposentadoria por idade mista ou h\u00edbrida, na qual h\u00e1 a contagem h\u00edbrida da car\u00eancia (n\u00e3o contributiva rural e contributiva urbana), exige que o trabalhador tenha 65 anos, se for homem, e 60 anos, se for mulher.<\/p>\n<p>O magistrado observou que esse tipo de aposentadoria \u201caplica-se \u00e0queles trabalhadores rurais que, por algum motivo, passaram a exercer labor urbano, independentemente de estarem vinculados ao campo no momento do implemento da idade ou do requerimento do benef\u00edcio\u201d.<\/p>\n<p>Para o relator, a trabalhadora atingiu a idade m\u00ednima e cumpriu o prazo de car\u00eancia exigido na lei. \u201cO in\u00edcio razo\u00e1vel de prova material, representado pelos documentos catalogados \u00e0 inaugural, corroborado por prova testemunhal id\u00f4nea e inequ\u00edvoca, comprova a condi\u00e7\u00e3o de segurada especial da parte-autora, a qual apresentou, ainda, documentos comprobat\u00f3rios de v\u00ednculos urbanos&#8221;, concluiu.<\/p>\n<p>A decis\u00e3o foi un\u00e2nime.<\/p>\n<p>Processo 1018782-82.2019.4.01.9999 &#8211;\u00a0\u00a0Data do julgamento e publica\u00e7\u00e3o: 01\/07\/2021<\/p>\n<p>Fonte: TRF1<\/p>\n<p>FALE CONOSCO E SAIBA MAIS.<\/p>\n<p>www.mainentitributos.com.br<\/p>\n<p>31 99775-5450 whatsapp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A 2\u00aa Turma do Tribunal Regional Federal da 1\u00aa Regi\u00e3o (TRF1), por unanimidade, manteve o pagamento pelo Instituto Nacional do Seguro Social (INSS) de aposentadoria por idade h\u00edbrida para uma trabalhadora rural, que tamb\u00e9m trabalhou na cidade por certo per\u00edodo.
