A postula\u00e7\u00e3o foi analisada em apela\u00e7\u00e3o contra a senten\u00e7a, do Ju\u00edzo da 6\u00aa Vara Federal da Se\u00e7\u00e3o Judici\u00e1ria do Distrito Federal, que julgou procedente o pedido quanto \u00e0 isen\u00e7\u00e3o tribut\u00e1ria somente sobre seus proventos de aposentadoria, uma vez que o demandante comprovou ter doen\u00e7a grave, nos termos do artigo 6\u00ba\/IX da Lei n\u00ba 7.713\/1988. Contudo, conforme jurisprud\u00eancia do Superior Tribunal de Justi\u00e7a (STJ) e do Supremo Tribunal Federal (STF), \u00e9 improcedente o pedido relativo aos rendimentos recebidos em atividade.<\/div>\n<div dir=\"auto\"><\/div>\n<\/div>\n<div class=\"cxmmr5t8 oygrvhab hcukyx3x c1et5uql o9v6fnle ii04i59q\">\n<div dir=\"auto\">O relator, desembargador federal Nov\u00e9ly Vilanova, destacou que mesmo comprovada a doen\u00e7a \u00e9 indevida a isen\u00e7\u00e3o do tributo sobre os rendimentos salariais do requrente em atividade, sendo esse benef\u00edcio devido somente sobre os proventos de aposentadoria.
