No pr\u00f3ximo dia 01.09.2023 o Supremo Tribunal Federal – STF retoma o julgamento desse imbr\u00f3glio, que, em consequ\u00eancia, poder\u00e1 ser alterado o entendimento quanto \u00e0 citada obrigatoriedade .<\/p>\n

O placar \u00e9 preocupante: cinco ministros j\u00e1 se manifestaram a favor da\u00a0 cobran\u00e7a de contribui\u00e7\u00e3o estabelecida em acordo ou conven\u00e7\u00e3o coletiva, desde que o trabalhador n\u00e3o se oponha ao pagamento.<\/p>\n

Como cedi\u00e7o, c contribui\u00e7\u00e3o assistencial (julgada inconstitucional pelo STF em 2017) difere do imposto sindical justamente justamente pela obrigatoriedade deste \u00faltimo, tornado opcional com a Reforma Trabalhista de 2017, dispositivo este \u00a0validado pelo STF em 2018. Para os ministros da Suprema Corte, exigir do trabalhador n\u00e3o sindicalizado a referida contribui\u00e7\u00e3o, implicaria n\u00edtida bitributa\u00e7\u00e3o, vez que aqueles j\u00e1 contribu\u00edam para manter o sistema sindical via imposto.\u00a0Desta decis\u00e3o foram interpostos embargos de declara\u00e7\u00e3o.<\/p>\n

Segundo os ministros Gilmar Mendes e Roberto Barroso, a contribui\u00e7\u00e3o passa a ter car\u00e1ter constitucional, desde que institu\u00edda por\u00a0 acordo ou conven\u00e7\u00e3o coletiva, devendo ser paga por todos os trabalhadores da categoria, ainda que n\u00e3o sindicalizados, assegurando-se o direito de oposi\u00e7\u00e3o. Dessa forma, recompor-se-\u00e1 a autonomia financeira dessas esp\u00e9cies de entidades. Acompanham tal entendimento os ministros\u00a0Dias Toffoli, Edson Fachin e C\u00e1rmen L\u00facia (que novidade!).<\/p>\n

Com o devido respeito aos profissionais s\u00e9rios que atuam junto \u00e0 estas entidades representativas da classe oper\u00e1ria, denota-se claramente o intuito de se voltar a financi\u00e1-las com os recursos dos trabalhadores, cobrados independentemente da sua vontade, nos moldes do imposto sindical.<\/p>\n

Melhor seria se os sindicatos buscassem, cada vez mais, prestar melhores servi\u00e7os aos seus associados, demonstrando as vantagens em se associar e se manter associado. Afinal, associa\u00e7\u00f5es tem por finalidade prec\u00edpua esta mesma: a de prestar servi\u00e7os aos seus associados, ao inv\u00e9s de usar tais recursos em pol\u00edtica partid\u00e1ria. Nesse ponto, aplaudimos de p\u00e9 aquelas institui\u00e7\u00f5es que, ante a aus\u00eancia do recebimento de pec\u00fania obrigat\u00f3ria, se recriaram e buscaram prestar servi\u00e7os essenciais aos seus associados.<\/p>\n

A exemplo de outros profissionais do Direito, entendemos que tal mat\u00e9ria n\u00e3o deveria ser objeto de aprecia\u00e7\u00e3o do Judici\u00e1rio, mas sim, do Legislativo, que a cada dia tem demonstrado sua in\u00e9pcia em responder aos anseios da sociedade, se tornando um “peso morto” para o contribuinte brasileiro e se curvando \u00e0s determina\u00e7\u00f5es judiciais.<\/p>\n

Aguardemos, pois, o que restar\u00e1 decidido acerca dessa tem\u00e1tica.<\/p>\n
